Swinburne: Court ruling respects tax sovereignty

Kay Swinburne MEP, Conservative spokesman in the European Parliament on economic and monetary affairs, today responded to a ruling on UK tax laws by the European Court of Justice.

The decision rejects a complaint brought by the EU Commission and states that UK legislation allowing cross-border group relief subject to certain conditions, introduced following the Marks & Spencer judgment, is compatible with EU law.

Dr Swinburne said: "Tax treatments are naturally complex but provided that all companies are treated equally with respect to the application of the rules, then individual countries should be allowed to set them as they see fit. Sovereignty over tax rules should be respected and glad that the ECJ in this instance has upheld this principle."
